Kansas Justice Institute, LLC is a public interest litigation firm protecting the freedoms guaranteed by the Kansas and United States Constitutions. The cases in litigation or that have been litigated during 2020 are as follows: 1.Modi, et al., v. Kansas State Board of Cosmetology, et al. - Ongoing case about occupational licensing and the right to earn an honest living free from unreasonable gov't interference. This action benefits the public in two ways: increased knowledge about onerous occupational licensing regimes; & if successful, will foster greater freedoms from unreasonable governmental interference. Claim was pleaded for attorney fees but have not sought fees. 2.Taylor, et al., v. Allen, M.D., et al - This case was a challenge to government overreach involving COVID-19 mandates which required physicians, lawyers, banks, dentists, restaurants and others to compile and disclose upon demand, for any reason, a list of the patrons, patients and clients. The public benefited by the local health officer changing the order. It protected the public's Fourth Amendment rights and it lead to the passage of the COVID-19 contact tracing privacy act. Claim was pleaded for attorney fees but none sought. 3.Ricky Dean's, Inc., d/b/a The Sandbar, et al., v. Marcellino, M.D., et al. - This case was a challenge to government overreach involving COVID-19 mandates which required restaurants and bars to stop serving alcohol at 11:00 p.m., regardless of the bars' COVID-19 mitigation procedures and protocols; prohibited bars from utilizing outdoor seating after midnight but permitted indoor restaurants without a liquor license to remain open after midnight; permitted curbside food sales after 11:00 p.m., but not curbside alcohol sales. The public benefited because it lead to the passage of due process hearings for those impacted by local health orders. Claim was pleaded for attorney fees but none sought. The Economic Freedom program represents efforts on tax policy. We publish original research and other written material, as well as speak to civic and other groups. The Student-Focused Education program strives to provide insights on spending choices for education. Extensive research is conducted in various education areas.
